Terms of sale

Article 1 — Purpose

These Terms and Conditions of Sale govern the contractual relationship between Olypiana (the "Seller") and any customer making a purchase on olypiana.com (the "Customer").

Article 2 — Products

The products offered for sale are those shown on olypiana.com. Product photographs and descriptions are provided for guidance. Minor variations in appearance and finish may occur within normal manufacturing tolerances.

Article 3 — Prices

Prices are shown in pounds sterling, inclusive of all applicable taxes. Olypiana reserves the right to change its prices at any time. Products will be charged at the price in force at the time the order is confirmed.

Article 4 — Orders

An order is confirmed once payment has been approved. You will receive a confirmation email. Olypiana reserves the right to cancel any order in the event of a stock or payment issue.

Article 5 — Payment

Payment is made online by payment card. All transactions are secure. Olypiana does not store any card details.

Article 6 — Delivery

Orders are dispatched within 1 to 3 working days. Estimated delivery times are 5 to 8 working days depending on destination. Olypiana cannot be held responsible for delays caused by the carrier or by customs.

Article 7 — Right to cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Customer has 14 days from receiving their order to exercise their right to cancel, without needing to give a reason. Olypiana extends this period to 30 days as a commercial goodwill commitment. Return postage is at the Customer's expense, except where the item is faulty or where we have made an error.

Article 8 — Guarantees

Products are covered by the statutory guarantees applicable to consumers.

For customers resident in the United Kingdom, this includes the rights set out in the Consumer Rights Act 2015: goods must be of satisfactory quality, fit for purpose and as described. Nothing in these terms affects your statutory rights.

For customers resident in France, the legal guarantee of conformity and the guarantee against hidden defects apply, in accordance with Articles L.217-4 and following of the French Consumer Code.

Article 9 — Liability

Olypiana shall not be held liable for indirect damage resulting from the use of the products. Individual results may vary. Photographs are not contractually binding.

Nothing in this article excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud.

Article 10 — Personal data

Data collected when you place an order is used solely to process that order. In accordance with the UK GDPR and the EU GDPR, you have the right to access, rectify and delete your data by contacting contact@olypiana.com.

Article 11 — Disputes

In the event of a dispute, we will always seek an amicable resolution first. Failing that, the courts of the Seller's registered office shall have jurisdiction, and French law shall apply.

If you are a consumer resident in the United Kingdom, you retain the right to bring proceedings in the courts of the United Kingdom, and you continue to benefit from the mandatory consumer protections of your country of residence.
